Why should I use this service when I can just contest it myself and ask for a trial in person? The cop isn’t going to show up anyway, right?

That’s a good question.  You can certainly request a trial with the game plan that the police officer will simply not show up and you’ll be off the hook.  It is our experience, however, that police officers almost always show up to traffic court trials.  They are paid time and a half to do so!  You can roll the dice, hey maybe he’ll be sick that day, but in reality it’s just that: a roll of the dice.  You can get lucky or crap out.

Wait a minute, I read online that the forms and trial by declaration are free! Why should I pay you for something I can get for free?

Do I need to pay right away?

What happens if I lose?

They say nothing in life is guaranteed and I suppose “they” are right.  If you lose you still have options.  You can request a “trial de novo”, which is a new trial in person with a new judge.  You can use the written defense we prepared for you at this new trial.  You can argue your case yourself or have a lawyer argue on your behalf.  We cannot represent you in court.  A trial de novo is quite special because you are entitled to it by law.  Nowhere else in the justice system are you entitled to a new trial simply because you didn’t like the outcome of the original trial.  You can even ask for traffic school or a reduced fine at this time and it is up to the judge to make that call. And yes, if we do not help you win your case you do get your money back.   It’s not like you didn’t get anything for giving us an opportunity to help you either because for the duration of the trial by declaration—a process of weeks if not months—your driving record will not be negatively impacted and your insurance rate will not increase.  If there is such thing as “buying time”, I think we’ve found it.
